This is an appeal from an order granting a new trial on the ground of misconduct of appellants’ counsel.

The appellants, the widow and minor children of Silas Snider, deceased, brought this action to recover for his death, which it is claimed was caused by the negligence of the respondent. The respondent owned and operated Natatorium Park, a place of amusement near the city of Spokane. Among the contrivances for amusement, was a circular swing, operated by electricity.
