This is an appeal in a condemnation case. The trial court granted a partial summary judgment determining that East Texas Salt Water Disposal, Inc. (ETSWD), had the authority to condemn the two acres on which the Bass # 5 salt water disposal well (Bass # 5) owned by Laird Hill Salt Water Disposal, Ltd. and Bolt-serv, Inc. (Laird Hill) 1 was located. The issues of compensation and trespass were then tried to a jury, who determined that there had been no trespass by ETSWD and awarded Laird Hill $24,700.00 for the Bass # 5.
