1Opinion of the Court

This is a suit by a real estate agent seeking to recover compensation alleged to have been earned as such agent. There was a nonjury trial, which resulted in a judgment against the plaintiff, and he prosecutes this appeal. There is no statement of facts, and the case is submitted in this court upon the following findings of fact filed by the trial judge:

"1. On August 10, 1913, the defendant W. M. Woods authorized plaintiff, a real estate broker, to sell for him a tract of land in Williamson county, Texas, described in paragraph 2 of plaintiff's first amended original petition at $30 per acre…
