The Court of Civil Appeals for the Fourth Supreme Judicial District have certified to this court the following statement and questions:

“This is a suit brought by J. M. Vance, trustee, and John P. Rice, Virgie Lee Rice, Daisy Rice, Frank Rice, and Lettie Rice, minors, who sue by their next friend, J. M. Vance, against J. P.
