—Appeal from a judgment of Supreme Court, Erie County (Sconiers, J.), entered October 17, 2001, after a jury verdict, in favor of plaintiff and against defendant Town of Amherst in the amount of $200,357.15.

It is hereby ordered that the judgment so appealed from be and the same hereby is unanimously affirmed without costs.
