CHATFIELD, District Judge.
The plaintiff (no longer “complainant”) has brought suit alleging that the defendant has infringed a certain patent duly assigned to the plaintiff after its issuance by the Patent Office with the usual letters patent. The plaintiff has also alleged the following;
