The defendant was convicted by a jury in Ward county of engaging in the liquor traffic as a second offense. The particular charge in the information was that on November 27, 1935, he had in his possession in the county of Ward, State of North Dakota, intoxicating liquors, after having pleaded guilty to and been duly sentenced on a charge of engaging in the liquor traffic on June 1, 1935, in Burleigh county.
