This action was commenced February 28, 1924, by Lena Fielder, as plaintiff, against J. J. Eaves and R. H. Brett, as defendants, to set aside a judgment obtained against her by the said J. J. Eaves on October 9, 1922, in an action in the district court of Carter county, wherein said J. J. Eaves was plaintiff and Karl Hel-bach, Lena Fielder, Premier gales & Electric Company, and the Indemnity Mutual Marine Assurance Company, of London, were defendants, to vacate the sale proceedings' under an execution issued out of said action, and to cancel the sheriff’s deed made to R.
