MEMORANDUM AND ORDER

THORNBURG, District Judge.

THIS MATTER came on for trial before the undersigned on July 14, 1998. For the reasons set forth below, the Court finds for the Defendant.

I. OPENING

In September 1932, the residents of Haywood County, a progressive rural county in Western North Carolina, gathered to dedicate their new courthouse which had taken over a year to construct. Defendant’s Exhibit 106, Program of the Dedication of Haywood County Court House, at 1, 7.
