DAVIDSON, Presiding Judge.

Appellant was convicted of murder in the second degree, his punishment being assessed at seven years in the penitentiary. A substantial statement of the evidence discloses that appellant was a tamale vendor and lived in the town of Ladonia with his family, ¿onsisting of his wife, a married daughter, a son-in-law, another daughter about grown, and some smaller children. The deceased, about twenty-two years of age, also resided in Ladonia. Appellant and the deceased were strangers to each other. The deceased was also a stranger to appellant’s family.
