The Commonwealth appeals from an order of the quarter sessions granting defendant’s motion in arrest of judgment. The indictment charged that defendant “did unlawfully, either accidentally or otherwise directly or indirectly, set fire to and cause to be set on fire, certain woodlands, forests, wild land and property, material and vegetation being and growing thereon, without permission of the owners.......by sparks, hot coals, and other inflammable material, emitted from a certain locomotive and railroad engine ......then and there operated by the agents and em ployees of…
