Statement.
This is a mandamus proceeding instituted in the circuit court of the city of St. Louis. Prom a judgment awarding a peremptory writ against him, appellant brings the case here by appeal.
Relator is the owner of lot 11, in city block 4539, of the city of St. Louis, fronting fifty feet on Oates avenue, on *4which. lot is erected a brick dwelling house containing bath tubs, wash stands, water closets and sinks.
