In an action to recover damages for personal injuries, the defendant Samuel Roth appeals, as limited by his brief, from so much of an order of the Supreme Court, Kings County (G. Aronin, J.), dated May 10, 2001, as denied that branch of his motion which was pursuant to CPLR 5015 to vacate a judgment of the same court (I. Aronin, J.), entered October 26, *4771999, on his default, or pursuant to CPLR 317 to open his default.

Ordered that the order is affirmed insofar as appealed from, with costs.
