Walter S. Hunt sued the Municipal Paving & Construction Company and its truck driver, George Corbitt, to recover for personal injuries and property damages sustained by him in a collision between his automobile and the company’s truck. He obtained a verdict and judgment for $2250, $2000 for his personal injuries and $250 for the damages to his automobile.

The company appealed in error and has assigned errors, insisting (1) that a verdict should have been directed for it because there is no evidence that it was negligent and the evidence shows plaintiff was guilty of contributory negligence;…
