In Hammond v. State, 303 Ga. App. 176 (692 SE2d 760) (2010), the Court of Appeals affirmed the trial court’s conviction of Timothy Hammond for sexual battery, aggravated sodomy, kidnapping with bodily injury, two counts of aggravated assault, two counts of burglary and one count of false imprisonment. We granted review to determine whether the holding in Garza v. State, 284 Ga. 696 (670 SE2d 73) (2008), applies retroactively and if it does, whether the trial court’s refusal to give Hammond’s requested instruction on asportation constitutes reversible error.
