The defendant, Emory Pope, appeals from a jury verdict for the plaintiffs — Triangle Chemical Company and BVC Distributing Company, on an open account. Plaintiffs alleged that they supplied fertilizer, chemicals, and other items to Pope and France Mathis to produce a cabbage crop. Plaintiffs contended that Pope and Mathis were partners and that Pope personally guaranteed the payment of the debt on the open account.
