This action was commenced by plaintiffs on February 27, 1933, for an accounting and claimed damages resulting from alleged breach of duty of defendants as directors and officers of the National City Bank of New York (hereinafter referred to as the *683bank) and of the National City Company, the name of which is now changed to the City Company of New York, Inc. (hereinafter referred to as the company).

The bank was established in 1812 and in 1865 was chartered as a national banking association for general commercial banking under the National Bank Act.
