MEMORANDUM AND ORDER ON DEFENDANTS’ MOTION TO DISMISS CERTAIN COUNTS OF THE SUPERSEDING INDICTMENT AS TIME-BARRED
STEARNS, District Judge.
In this case, the court is asked to determine whether the United States is presently at war, and if so, with whom. Defendants are charged with conspiracy, mail fraud, and the making of false statements in connection with the federally-financed Central Artery Tunnel Project (CA/T).
