MCHUGH, United States District Court Judge

This case arises out of a physical altercation between two employees, one of whom was not only terminated but was *205ultimately found guilty of criminal charges as a result of his conduct. Plaintiff contends that the outburst resulting in his discharge- and conviction was the product of a racially hostile work environment. Discovery is now complete. Although the record might support an inference that Plaintiffs co-worker was racially insensitive and rude, the evidence is not sufficient for a jury to find the kind of pervasive conduct legally…
