Priscilla Barry, buyer, sued Stop and Shop Companies, Inc. (Stop and Shop), seller, and Wheeler Manufacturing Co., manufacturer, for an alleged breach of an implied warranty of merchantability of a lawnmower, resulting in injuries to her person. 2 After trial, a jury brought in verdicts against the defendants for $30,000, but the judge, having de nied the defendants’ motions for directed verdicts, allowed their motions for judgments n.o.v. and denied the plaintiff’s motion for a new trial; 3 these latter rulings are the subject of the plaintiff’s appeal.
