NIX, Presiding Judge.

Timothy Clayton Thomas, plaintiff in error, who shall hereinafter be referred to as the defendant was charged by information in the District Court of Oklahoma County with the crime of Grand Larceny. He was tried before a jury and found guilty. The jury left the punishment to be assessed by the trial judge. Subsequent thereto in an unusual procedure, and before judgment and sentence, defendant entered a plea on said charges and was by the trial court sentenced to 2½ years in the Oklahoma State Penitentiary, and was thereupon committed to the state penitentiary to begin his…
