NIX, Judge.
John D. Shanahan, hereinafter referred to as the defendant, was charged by information in the Common Pleas Court of Oklahoma County with the crime of the illegal transportation of intoxicating liquor. He was found guilty by a jury that was unable to agree upon the punishment and left the punishment to be assessed by the court. The court sentenced defendant to serve ten days in the county jail and to pay a fine of $50 and costs.
The defendant appeals to this Court asserting three propositions of error upon which he relies for reversal or modification. That:
