This is a suit at law to recover hack moneys paid under protest to the collector of the port of New York, by the plaintiffs. It has been tried before the court without a jury, on an agreed statement of facts, the material parts of which are as follows; The plaintiffs are partners in trade in the city of New York, and carry on a business of transporting passengers and freight on the high seas, between Holland and the United States, as consignees and agents.
