Jetty Lee Harvey (Harvey) appeals from the district court’s order of February 1, 1995, Harvey v. Shillinger, 893 F.Supp. 1021 (D.Wyo.1995) (Harvey III), dismissing his petition for a writ of habeas corpus filed pursuant to 28 U.S.C. § 2254.

Facts

On January 9, 1986, Harvey and two others were charged in the District Court, Third Judicial District, Sweetwater County, Wyoming, with kidnapping and sexual assault in the first degree or aiding and abetting in those offenses.
