I shall proceed to consider the first point made in the brief furnished us by the counsel for the complainants. Had the defendant a legal right to become the purchaser of the lands in controversy, it being admitted that they were sold by him asbounty treasurer, under the provisions of the law of 1843, for the assessment and collection of taxes?
