The plaintiff in error will be designated as appellant and the defendant in error as appellee. The substance of the testimony incorporated in the record is that the People’s State Bank of Pearsall, Tex., owned a tract of land in Comanche county and listed the same for sale with the appel-lee, who was a real estate broker. The ap-pellee made a number of unsuccessful efforts to find a purchaser for the property.
