BRICE, Justice.
The appellant filed a bill in the district court to enjoin the collection of certain taxes assessed and levied by the appellee upon appellant’s property situated within the corporate limits of the appellee town. Appellee answered alleging that under a special charter granted to that town in 1878 it had authority to assess and levy such taxes, and such authority had never been repealed by the Legislature.
