This is a condemnation suit, brought by the City of Dallas to condemn 1.8 acres of land out of a tract containing 4.5 aerQs, owned by Ruby Andrews and others. The City of Dallas was' awarded the land for the sum of $273.00. Respondents appealed to the Court of Civil Appeals, and that court, on motion for rehearing, held that the trial court erred in its ruling relating to the argument made by the attorney for respondents to the jury, and by a divided court reversed and remanded the cause for another trial. 232 S. W. 2d 753.
