David D. Jones, a coal mine operator, was indicted under the second section of the twenty-first article of the act of May 15, 1893, charged with having violated the provisions of the first *367and second sections of tbe second article. Tbe indictment was quashed on the ground that the act of assembly under which it was framed is unconstitutional, whereupon the commonwealth appealed.
