SMITH, Circuit Judge.
This action was brought by the United States against the plaintiff in error for an alleged violation of the hours of service act (34 Stats. 1415). It was alleged in the two counts of the complaint that the company was engaged in interstate commerce and permitted its engineer J. E. Gasow, and its fireman S. Steen, each to be and remain on duty from 6 o’clock p. m. of February 2, 1915, to 11 o’clock a. m. on February 3, 1915.
