Plaintiff Lena Lasher ("Lasher") has brought this action under 42 U.S.C. § 405(g) challenging the decision of the Secretary of Health and Human Services ("DHHS") to exclude her from participation in federal health care programs for *245a period of 10 years.1 This matter is before the Court on the Defendants' Motion to Dismiss or, in the Alternative, for Summary Judgment.
