This case comes before this Court on appeal on questions of law- and fact from a judgment of the Court of Common Pleas • of Fayette . County. The pleadings in the case are lengthy and we shall present the salient points as briefly as possible.

The plaintiff alleges that the defendant is the owner of 25 acres in the Township of Jasper, County of Fayette, adjoining the lands of the plaintiff; that the plaintiff is the owner of a tract-through and over which a watercourse or channel is located; that the natural flow of the surface water has its head in the lands of Ewing and…
