In August, 1918, James M. Woodson, Jr., applied for a 10-pay life insurance policy in the Missouri State Life Insurance Company, the amount of the policy applied for being $12,500. The application was taken by J. F. Duncan, appellant’s general agent. Duncan went to a farm near Plainview on August 2, 1918, accompanied by A. Gf. Hemphill, for the purpose of discussing a life insurance transaction with some person other than Woodson.
