Thiele, J.:

This was an action against an administrator to recover for personal services rendered the decedent in her lifetime.

Margaret Schindler died March 15, 1930, and on March 17 the First Trust Company of Wichita was appointed administrator of her estate and duly qualified.

On March 5, 1931, Anna Bristow exhibited her claim to the administrator and filed the same in the probate court. The demand was exhibited under R. S. 22-705, and no notice as required by R. S. 22-712 was given, nor was there any waiver in writing as provided in R. S. 22-714. On…
