The plaintiff here is the Joint Venture of Domenech, Hicks and Krockmalnic and Hezekiah Pratt Associates, Inc. (“Plaintiff’). Before the Court is the Plaintiffs Application for an Order Vacating the Arbitration Award pursuant to G.L.c. 251, §§12(3) and 12(5). The essence of the Plaintiffs claim is that the defendant Massachusetts Housing Finance Agency (“MHFA”) is not the real party in interest to the agreement underlying the dispute as required by Mass.R.Civ.P. 17(a).
