MILLER J.

A. L. Jeff coat sues the Atlantic Coast Line Railroad Company, a corporation, for personal injuries. Only one count in the complaint was submitted to the jury, which vas numbered 1. This count states a cause of action under the federal Employers’ Liability Act for injuries alleged to have been sustained by the plaintiff, an employé of the defendant, by being run upon or against by a moving locomotive as the result in whole, or in part from the negligence of one John Jones, an employe of the defendant, while acting within the line of his employment.
