The libellant applied for a divorce in the Court of Common Pleas No. 3 of Philadelphia County on the ground of wilful and malicious desertion alleged to have taken place on or about June 12,1935.

An answer having been filed to the libel, the case was referred to Maxwell L. Davis, Esq., as master, who, after hearing testimony, filed his report recommending the libel be dismissed. < Exceptions were filed to the report of the master, argued and dismissed in a per curiam opinion.
