Appellants brought this action against respondents to rescind the sale of all the capital stock in a certain corporation. The case came to trial before a jury. When after a dismissal of one of the counts of the complaint appellants refused to introduce evidence to support the remaining allegations of the complaint, judgment of nonsuit was entered for respondents. The judgment was appealed to this court, but the appeal was dismissed because a cross-complaint then pending prevented the judgment from being final. (Grocker-Anglo National Bank v. Kuchman, 194 Cal.
