After the death of deceased letters of administration on her estate were issued to her surviving spouse. Thereafter a paper was propounded as deceased’s will. The letters to the spouse were thereupon suspended. The surviving spouse filed objections to the probate of the propounded paper. The present motion seeks to strike out his objections.
The moving parties assert that a valid antenuptial agreement entered into between deceased and objectant deprives him of any interest in deceased’s estate and now operates to deny him the status of objectant to the probate of deceased’s will.…
