Defendants were the subject of a four count indictment returned originally on May 26, 1971 by a grand jury in the Southern District of New York and superseded by a second indictment on December 15, 1971, in order to correct a clerical error. Count 1 charged a conspiracy to violate 18 U.S.C. § 1952 (in terstate and foreign travel or transportation in aid of racketeering enterprises) and 18 U.S.C. § 1084 (transmission of wagering information by wire communication in interstate commerce).
