On August 25, 1939, in a collision on Highway No. 35, in Polk County, between a Chevrolet car driven by Sidney Lewis, in which Charles Applebhy, a minor, was riding as a passenger, and a truck owned and operated by Houston Oxygen Company, Inc., driven by Oliver R. Stanbury, appellants, Charles Applebhy received serious personal injuries, resulting in the loss of his arm and other injuries.
