On March 1, 1988, a Middlesex County grand jury indicted the defendants, Michael Lauria, Edward Long, and Michael Joyce on charges of aggravated rape, kid napping, assault by means of a dangerous weapon, and indecent assault and battery. On December 12, 1989, the defendants filed motions to dismiss the indictments on the ground that they had not been brought to trial within twelve months of their arraignments as required by Mass. R.
