Plaintiff Central States, Southeast and Southwest Areas Pension Fund (“Central States” or “Plaintiff’) filed a complaint against Defendant Phencorp Reinsurance Company, Inc. (“Phencorp” or “Defendant”) to recover payments allegedly owed to Central States by Phencorp’s parent company, Philip Services Corporation (“PSC”) pursuant to the Employee Retirement Income Security Act (“ERISA”).
