The defendant has moved this court for an order dismissing the complaint which charges him with vehicular homicide, in violation of R.C. 2903.07. The prosecution and the defense are in substantial agreement with regard to the underlying facts of this event. Therefore, for the purpose of this motion, the parties have submitted an agreed statement of facts to the court for its consideration.

The agreed statement of facts conclusively establishes the following events:
