On December 16, 1942, plaintiff appellant Charles Priekett, administrator of the estate of Dale B. Prickett, deceased, filed a suit at law in the circuit court of Montgomery county against the defendant appellee, City of Hillsboro and one John Olroyd, since deceased, seeldng recovery of damages alleged to have been sustained by the next of kin of said Priekett under the provisions of the Illinois Injuries Act (ch. 70, Ill.
