Appeal from a judgment of the superior court for King county, Main, J., entered June 23, 1907, upon sustaining a demurrer to the complaint, dismissing an action for an accounting.

On the 5th day of February, 1890, the respondents executed and delivered to John Brown their bond for a deed to certain lands in Seattle, conditioned upon the payment of a sum of money on or before October 1, 1890. The amended complaint alleges the payment of this sum prior to the time fixed, and the death of John Brown on September 17, 1894, leaving him surviving Earl Brown, a son, and *82Loretta A.
