CHRISTENBERRY, District Judge.

This case is before the Court on motion by defendant Federal Barge Lines, Inc. for dismissal of the action or alternatively for summary judgment on the grounds that plaintiff’s cause of action does not lie within the admiralty jurisdiction of this Court and that as a matter of law the movant is entitled to the relief requested. This Court treats the motion as a request for summary judgment pursuant to Rule 56.
