(concurring specially) — Considering the facts and circumstances involved, I believe that the majority opinion authorizes a fair and equitable, and altogether proper, disposition of the property as to which the litigants assert an interest or claims of ownership. It is because of this, and not so much for the reasons stated by the majority, that I have signed the opinion.
