John Scott instituted this suit against appellant Railway Company in the justice court of Oldham county, Tex., April 8, 1911, to recover $150 damages, growing out of a cattle shipment from Vega, Tex., to Kansas City, Mo., the shipment alleged to have been made about October 1, 1910. Upon a trial in the justice court judgment was rendered for plaintiff Scott for the amount claimed and costs of suit. Appellant herein by appeal removed the case to the county court of Oldham county, and in that court moved to dismiss the cause because no claim or demand was ever lodged with the justice of the…
