MEMORANDUM OPINION

I. INTRODUCTION

Arnold and Eileen Ries (the “Debtors”) filed a petition for relief under chapter 13 of the Bankruptcy Code 1 on February 12, 2007 (the “Petition Date”). They subsequently filed their First Amended Chapter 13 Plan (the “Amended Plan”) on June 14, 2007. On June 18, 2007 the Court held a confirmation hearing (the “Confirmation Hearing”) during which Lawrence Sumski, the chapter 13 trustee (the “Trustee”), objected to confirmation of the Amended Plan because it did not adhere to the confirmation requirements of § 1325.
